Terms of Service

Last updated: 20 July 2026. Please read these terms before using XENA or taking out a subscription.

1. Acceptance of these terms

By creating an account, accessing, or using XENA (xenadefence.com), you agree to these Terms of Service and our Privacy Policy. If you don't agree, don't use the service. XENA is operated by Xena Defence ("XENA", "we", "us"), registered in the United Arab Emirates [registration number pending], registered address Sharjah Research Technology and Innovation Park (SRTIP), Sharjah, United Arab Emirates.

2. What XENA is

XENA is a defence-industry market intelligence platform: news, analysis, company and country data, spending forecasts, and related tools, aggregated and synthesised from public sources plus XENA's own analysis.

XENA is provided for informational purposes only. Nothing on the platform — including forecasts, scores, analyst-outlook labels, comparison tools, or "implications analysis" pieces — constitutes investment advice, financial advice, legal advice, or a recommendation to buy, sell or hold any security. XENA is not a registered investment adviser or broker-dealer. You are solely responsible for any decision made using information from the platform, and should consult a qualified professional before making investment, procurement, or legal decisions.

3. Accounts

You must be at least 18 to create an account. You're responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity under your account. Tell us immediately at [email protected] if you suspect unauthorised access. One account per individual — accounts are not to be shared across multiple users except where an Enterprise agreement explicitly permits seats.

4. Plans

Public preview — a limited view of news, company and capability records, readable without an account and without payment. Standard subscription — $499 per user per month, unlocking in-depth reporting, forecasting, financial models, alerts, watchlists and portfolio monitoring as described on the pricing page at time of purchase. Enterprise — custom scope and pricing, including programmatic API and MCP access, agreed separately in writing. Access is arranged by request rather than self-serve purchase. Feature availability is as shown on the pricing page, which may be updated from time to time as the product evolves (see Section 12).

5. Free trials & promotions

[Placeholder — confirm with Mal whether any trial period, discount code, or promotional pricing is offered, and its terms, before publishing.]

6. Billing, renewal and cancellation

Subscriptions are billed in advance and renew automatically until cancelled. Billing and cancellation are arranged directly with us; cancellation takes effect at the end of your current billing period and you keep access until then. [Refund policy to confirm with Mal — as drafted, no pro-rata refunds are given for a partial month, except where required by applicable consumer law.] Prices may change with notice; continued use after a price change takes effect constitutes acceptance of the new price for your next billing cycle.

7. Acceptable use

You agree not to: scrape, systematically extract, or bulk-download XENA data beyond normal interactive use; resell, redistribute or sublicense XENA data or analysis to third parties without our written permission; reverse-engineer or attempt to bypass tier/paywall restrictions; use the platform for any unlawful purpose; or interfere with the platform's normal operation (including attempting to overload, disrupt, or gain unauthorised access to our systems). We may suspend or terminate accounts that breach this section.

8. Intellectual property

The underlying facts we report (e.g. a contract award, a company's published revenue) are public information and aren't owned by anyone. XENA's own synthesis, analysis, scoring, forecasts, formatting, and the platform itself are the intellectual property of Xena Defence and may not be copied, reproduced or redistributed without permission, beyond what's reasonably needed for your own personal or internal business use of a standard or enterprise subscription.

9. Disclaimers & limitation of liability

XENA aggregates and analyses information from public and third-party sources. We take reasonable care in how we compile and present it, but we do not guarantee that every figure, forecast or classification is complete, current, or error-free — see our methodology & sources. The platform is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law.

To the fullest extent permitted by law, Xena Defence will not be liable for any indirect, incidental, or consequential losses (including lost profits or investment losses) arising from your use of, or reliance on, XENA. [Placeholder — a lawyer should confirm the appropriate liability cap for this jurisdiction and business type; a common approach is capping direct liability at fees paid in the preceding 12 months, but this must be reviewed, not assumed.]

10. Termination

You may stop using XENA and cancel your subscription at any time. We may suspend or terminate your account if you breach these terms, including the acceptable-use rules in Section 7, or if required to do so by law.

11. Governing law

These terms are governed by the laws of the United Arab Emirates, and any dispute will be subject to the exclusive jurisdiction of the courts of the United Arab Emirates, without prejudice to any mandatory consumer-protection rights you may have in your own country of residence. [Placeholder — this needs a lawyer's confirmation, not an assumption: which UAE court system actually applies (mainland Sharjah/UAE civil courts, versus a specific free-zone court framework if Sharjah Research Technology and Innovation Park operates under one) affects both the substantive law — UAE civil law vs. a common-law free-zone framework like DIFC/ADGM — and where a dispute would actually be heard.]

12. Changes to these terms

We may update these terms as the product evolves. We'll update the date at the top of this page, and for material changes affecting paying subscribers, we'll notify you by email in advance of the change taking effect.
